Terms and Conditions

Aligned Experiences Travel Services Agreement

This Travel Services Agreement ("Agreement") is entered into between ALIGNED EXPERIENCES ("Company," "we," "our," or "us") and the traveler, customer, or person making a booking ("Client," "Traveler," or "you").

By making a booking, paying a deposit, accepting a proposal, completing an online reservation, signing electronically, or otherwise using our services, the Client agrees to be legally bound by this Agreement.

Company Services

ALIGNED EXPERIENCES provides travel planning, concierge, coordination, reservation, and booking assistance services, including but not limited to:
 

  • Curated travel packages

  • Custom travel itineraries

  • Accommodation arrangements

  • Ground and sea transportation coordination

  • Activity and excursion planning

  • Airline booking assistance

  • Dedicated host services

  • Travel insurance assistance

  • Optional upgrades and add-on services
     

ALIGNED EXPERIENCES acts solely as an independent travel concierge, booking intermediary, and agent for third-party suppliers. The Company does not own, manage, operate, control, or supervise airlines, hotels, resorts, transportation providers, tour operators, activity providers, or other travel suppliers.

Booking and Reservation Process

A booking may be made through our website, booking forms, email, social media platforms, messaging applications, or other authorized communication channels.

No booking shall be considered confirmed until:

  • Required traveler information has been submitted;

  • Required payments have been received and verified; and

  • Written confirmation has been issued by ALIGNED EXPERIENCES.

  • The Company reserves the right to decline any booking request at its discretion.

Payment Terms

1. Currency
All prices, invoices, fees, and payments are stated and payable in United States Dollars (USD) unless otherwise specified in writing.

2. Deposit
A non-refundable and non-transferable deposit equal to fifty percent (50%) of the total booking value is required to secure reservations.

3. Final Payment
The remaining balance must be paid in full no later than seven (7) calendar days prior to departure unless otherwise stated in writing.

4. Failure to Pay
Failure to make payment by the required deadline may result in:

  • Automatic cancellation of the booking;

  • Loss of deposits and previously paid amounts;

  • Additional supplier penalties;

  • Rebooking charges.


5. Price Adjustments
Prior to final confirmation, prices may change due to:

  • Supplier price increases;

  • Exchange rate fluctuations;

  • Fuel surcharges;

  • Government taxes or fees;

  • Seasonal demand;

  • Availability changes.
     

*The Client shall be responsible for any such increases before final confirmation.

Cancellation and Refund Policy

1. Client Cancellation

Cancellation requests must be submitted in writing.

Refund eligibility shall be determined according to supplier policies, unrecoverable costs, administrative expenses, and amounts recoverable by the Company.

 

2. Refund Schedule

  • More than 30 days before departure: Refund may be available less supplier penalties and administrative costs.

  • 14 to 30 days before departure: Partial refund may be available depending on supplier recovery.

  • 7 to 13 days before departure: Refunds are generally unavailable unless recoverable from suppliers.

  • Less than 7 days before departure: No refund.

 

3. Non-Refundable Situations

No refund shall be issued for:

  • Deposits;

  • No-shows;

  • Missed flights or transfers;

  • Unused services;

  • Voluntary itinerary changes after confirmation;

  • Personal emergencies not covered by travel insurance;

  • Failure to meet entry requirements.

Changes and Amendments

Any requested changes after booking confirmation, including changes to dates, accommodations, activities, transportation, traveler information, or itinerary details, may result in:

  • Administrative fees;

  • Supplier penalties;

  • Fare differences;

  • Additional costs.

All changes are subject to availability and supplier approval.

Travel Insurance

Travel insurance is mandatory.

Clients must obtain travel insurance covering, at minimum:

  • Medical emergencies;

  • Trip cancellation;

  • Trip interruption;

  • Travel delays;

  • Personal accidents;

  • Loss or theft of belongings.

Proof of insurance may be required before final payment.

Failure to obtain adequate insurance is solely at the Client's risk.

Client Responsibilities

The Client is solely responsible for:

  • Valid passports;

  • Visa requirements;

  • Entry permits;

  • Vaccination requirements;

  • Health documentation;

  • Travel insurance;

  • Compliance with local laws and regulations.

The Company shall not be responsible for denied boarding, denied entry, deportation, immigration issues, documentation deficiencies, or related losses.

The Client agrees to provide complete and accurate information. The Company shall not be responsible for losses arising from inaccurate or incomplete information provided by the Client.

Travel Advisories and Seasonal Conditions

Clients are responsible for monitoring travel advisories, entry requirements, weather conditions, and destination-specific restrictions.

The Company does not guarantee favorable weather, accessibility, local operating conditions, or uninterrupted travel services.

Travel experiences may vary due to environmental, operational, governmental, supplier, or local conditions.

Third-Party Suppliers

All airlines, hotels, transportation providers, activity operators, guides, tour companies, and other travel suppliers are independent contractors.

ALIGNED EXPERIENCES is not responsible for:

  • Supplier negligence;

  • Delays;

  • Cancellations;

  • Overbookings;

  • Service interruptions;

  • Property damage;

  • Personal injury;

  • Death;

  • Acts or omissions of suppliers.

All bookings remain subject to the supplier's own terms and conditions.

Assumption of Risk

The Client acknowledges that travel involves inherent risks including:

  • Illness;

  • Injury;

  • Accidents;

  • Transportation incidents;

  • Natural disasters;

  • Weather disruptions;

  • Theft;

  • Political unrest;

  • Other unforeseen events.

The Client voluntarily assumes all risks associated with travel and participation in activities included in the itinerary.

Medical Emergencies

In the event of a medical emergency, the Client authorizes medical treatment deemed reasonably necessary by healthcare providers or local authorities.

All medical expenses, transportation costs, evacuation expenses, and related costs remain the sole responsibility of the Client.

ALIGNED EXPERIENCES shall not be responsible for medical costs or consequences arising from illness, injury, or emergency treatment.

Client Conduct

Clients shall:

  • Respect local laws and customs;

  • Follow itinerary schedules;

  • Conduct themselves respectfully toward staff, suppliers, and other travelers;

  • Comply with supplier policies.

The Company may suspend or terminate services without refund where a Client:

  • Violates laws;

  • Engages in abusive conduct;

  • Endangers others;

  • Provides fraudulent information;

  • Fails to meet payment obligations.

Client Liability for Damages

Clients shall be financially responsible for all losses, damages, repair costs, penalties, cleaning fees, claims, or liabilities resulting from their actions, negligence, misconduct, or violation of supplier rules.

Force Majeure

The Company shall not be liable for delays, cancellations, disruptions, losses, or failures caused by events beyond its reasonable control, including:

  • Natural disasters;

  • Typhoons;

  • Floods;

  • Earthquakes;

  • Pandemics;

  • Government restrictions;

  • Political unrest;

  • Acts of terrorism;

  • Labor strikes;

  • Transportation disruptions.

Any refund, credit, or rescheduling shall be governed solely by applicable supplier policies.

Limitation of Liability

To the maximum extent permitted by law, ALIGNED EXPERIENCES shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including:

  • Loss of enjoyment;

  • Emotional distress;

  • Lost opportunities;

  • Lost profits;

  • Travel interruptions;

  • Consequential losses.

The Company's total liability arising from any claim shall not exceed the amount actually paid directly to ALIGNED EXPERIENCES for concierge services.

Indemnification

The Client agrees to defend, indemnify, and hold harmless ALIGNED EXPERIENCES, its owners, officers, employees, contractors, representatives, and affiliates from any claims, damages, liabilities, costs, losses, or expenses arising from:
 

  • Client misconduct;

  • Breach of this Agreement;

  • Violation of laws;

  • Negligence;

  • Participation in travel activities.

Payment Disputes and Chargebacks

Clients agree not to initiate chargebacks or payment disputes for services properly provided or governed by the cancellation terms of this Agreement.

The Company reserves the right to recover all unpaid balances, collection costs, administrative fees, legal expenses, and damages permitted by law.

Website Use and Intellectual Property

All itineraries, branding, content, travel concepts, package designs, photographs, graphics, and materials are the exclusive property of ALIGNED EXPERIENCES.

No content may be copied, reproduced, distributed, modified, or resold without prior written consent.

Data Privacy

The Company may collect, process, store, and share personal information with suppliers and service providers for legitimate travel-related purposes.

By booking, the Client consents to such processing in accordance with applicable laws, including the Data Privacy Act of 2012 of the Republic of the Philippines.

Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of the Republic of the Philippines. The parties agree to first attempt to resolve disputes through good-faith negotiation.

 

If unresolved, disputes shall be submitted to mediation prior to litigation whenever permitted by law. Any legal action shall be brought before the appropriate courts of the Republic of the Philippines.

Electronic Acceptance

Electronic signatures, digital payments, online confirmations, website checkbox acknowledgments, email approvals, and electronic communications shall constitute valid and binding acceptance of this Agreement.

Entire Agreement

This Agreement constitutes the complete understanding between the parties and supersedes all prior discussions, representations, proposals, negotiations, and communications.

Severability

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Modification of Terms

ALIGNED EXPERIENCES reserves the right to amend or update these Terms and Conditions at any time. Updated versions shall become effective upon publication unless otherwise stated.

Acceptance

By reading the terms stated above, making a booking, paying a deposit, completing an online reservation, or otherwise using the services of ALIGNED EXPERIENCES, the Client acknowledges that they have read, understood, and agree to be bound by this Agreement.
